Information Management Agreement

The Faculty of Medicine and Dentistry (FoMD) will establish an Information Management Agreement (IMA) for physicians and dental members who must comply with the Alberta Health Information Act (HIA). If you are a member of foMD, you must sign an IMA in one of three circumstances in which Alberta/FoTM Is acting as an information manager: (2) A custodian must enter into a written agreement with an information manager in accordance with the provisions governing the provision of one or all of the services described in the subsection (1). As administrators under the Health Information Act (HIA), physicians are responsible for the retention and control of their patients` health information. EMR suppliers are not trustees. All physicians are reminded to review their information manager agreements to ensure that they have signed the agreement as an administrator. Section 66 of the EFA requires, where appropriate, that a health information manager be required to enter into a written information management agreement with another administrator or a third party that provides information management services: U of A/FoMD staff manages identifiable health information for patients. 3. A custodian who has an agreement with an information manager may provide health information to the information manager without the consent of the persons involved for the purposes of the agreement. (1) An “information manager” refers to a person or organization that physically stored your patients` identifiable health information in a U of A building. Your patients` identifiable health information is stored or managed electronically by FoMD MedIT or U of A Information Services and Technology (IST). 4. An administrator of the information made available to the information referred to in point 3 above may only use or disclose this information for the purposes authorized by the agreement.

(6) Notwithstanding paragraph 5, point a), a custodian remains responsible for compliance with this law and the rules relating to information provided by the custodian to the information manager. A custodian who is an information manager for another administrator does not become the custodian of the health information provided to him as information manager, but nothing in this section prevents the custodian from otherwise collecting, using or disclosing this health information in accordance with this law. 5. An information manager must (a) comply with this law and the rules and (b) the agreement with a custodian with respect to the agreement reached to him in accordance with subsection 3.
